The highly anticipated TOD SEPP has been gazetted! Now Chapter 5 in the Housing SEPP, controls for 18 of the 37 station precincts will come into effect on 13 May 2024.
The key controls to apply within 400m of stations in these precincts include:

RFBs to be permissible in residential and local centre zones.

Shop top housing to be permissible in local centre and commercial zones.

A maximum 22m height for RFBs and 24m height shop top housing.

A maximum FSR of 2.5:1.

Minimum lot width of 21m and no minimum lot size.
-
Active street frontages required at the ground floor.
-
No change to heritage controls in local LEPs.

The ADG will continue to apply.

A 2% mandatory affordable housing contribution for developments with a GFA over 2000sqm. This is to be delivered onsite, in-perpetuity, and managed by a Community Housing Provider. The percentage of the affordable housing contribution will increase over time.
The remaining 19 station precincts will be released progressively over the next year to June 2025. Local Councils will be working with the NSW Department of Planning, Housing and Infrastructure to complete master plans for uplift in these remaining precincts.
